PHILADELPHIA - The family of the officer who became Temple University Police Department's first line-of-duty death has filed a lawsuit against his alleged killer's parents. According to Marrone Law Firm, LLC, the legal representation for the family of Sgt. Chris Fitzgerald, the civil action lawsuit was filed against 18-year-old Miles Pfeffer's father, mother and the mother's boyfriend. The lawsuit was filed in the Philadelphia County Court of Common Pleas on Thursday morning, alleging the trio is liable for negligence and wrongful death in the fatal shooting.

ASHEVILLE, North Carolina (FOX 9) - A young black bear scared a man as he relaxed outside his Asheville, North Carolina, home on Wednesday.A security camera (watch it in the player above) on David Oppenheimer's home captured the bear cautiously approaching him while he was scrolling on his phone outside. Oppenheimer jumped in surprise when he noticed the bear nearly at his feet."Hi bear, we're going to be famous," Oppenheimer said while trying to keep the animal calm.Oppenheimer then took out his phone and began recording as the bear inspected his coffee, to which he said, "Please don't drink my coffee." The bear then wandered onto Oppenheimer's deck, before strolling away.Oppenheimer told Storyful black bears frequent his neighborhood.Not even a Diaper Genie is safe against a black bear.

David Cupery 29, of Millsboro has been charged with offensive touching and disorderly conduct after a fight broke out at a Delaware high school graduation.  GEORGETOWN, Del. - A graduation for a Delaware high school ended in turmoil on Tuesday night after state troopers say a large fight broke out. According to officials, troopers working the Sussex Central High School graduation responded to a large crowd of people fighting outside the main gate to the ceremonies. Responding troopers saw a 48-year-old Millsboro woman being kicked and punched by a 16-year-old girl and a 29-year-old Millsboro man punching people, including the same teenage girl, authorities say. Troopers say they contacted the teenage girl, who walked across a softball field and began fighting again. Police say the teenage girl and her father, who troopers spoke with, have not cooperated with the investigation. MORE LOCAL HEADLINESAccording to authorities, troopers were able to break up the fight and disperse the crowd. No victims remained on scene to report their injuries or provide accounts of what happened, officials say. The agency says the investigation led law enforcement to the 48-year-old woman, who then reported her injuries and her daughter's injuries to state police. Troopers say the woman had a scratch on her nose, while her daughter had a black eye and swollen nose. The 16-year-old girl observed fighting was identified by police as the person who hit the woman and her daughter, and a warrant for her arrest has been issued, according to law enforcement. She and the Millsboro woman's teenage daughter are not students at Sussex Central High School, troopers say. According to officials, the 16-year-old teen is expected to be charged with

PHILADELPHIA - Philadelphia police are investigating a shooting that erupted outside a Philadelphia hospital early Thursday morning. According to authorities, three men were shot on the 3400 block of Germantown Avenue right outside the emergency entrance of Temple University Hospital around 12:30 a.m.Officers from the 24th Philadelphia police district and Temple University police responded to the scene, according to Chief Inspector Scott Small. Authorities say an 18-year-old was shot in the hand, a 22-year-old man was shot in the knee and a 25-year-old man was shot in the face, back and arm. MORE LOCAL HOSPITALSAccording to Small, all three victims walked themselves into the emergency room for treatment and are in stable condition. Police say more than 40 shots were fired, including bullets that struck the hospital building. Investigators were observed on scene placing dozens of evidence markers down outside the hospital. The motive for the shooting remains unclear, police say. Three people were injured in a triple shooting outside of Temple University Hospital's emergency room.

PHILADELPHIA - The new leader of SEPTA's police force is ready to tackle the tall task of improving safety and restoring confidence in the nation's sixth-largest public transportation system.Chief Chuck Lawson, who spent 30 years as a transit officer, said reducing gun violence on SEPTA property is "undoubtedly" the biggest challenge he's facing. "My biggest challenge undoubtedly right now is gun violence we’re seeing on the system that we’ve never experienced in previous years," Chief Lawson said.This week alone, a 19-year-old man was shot on the 15th and Market street platform. PHILADELPHIA - A man is fighting for his life and a teenager is injured after police say someone shot them Wednesday night in North Philadelphia. Officers from the Philadelphia Police Department were called to the 1800 block of Woodstock Street for reports of a shooting. Police found an 18-year-old shot in the foot and another man shot in the head. Both were taken by police to Temple University Hospital. No arrests were immediately reported.

PHILADELPHIA - A national shortage of certain cancer-fighting drugs has patients frightened they won't receive the life-saving treatment they need to continue their heroic fight.The American Cancer Society Cancer Action Network says hospitals across the country are short on several key chemotherapy drugs. In a statement released earlier this month, CEO Karen E. Knudsen said the shortages that are caused by factors like expanded demand, limited manufacturing capacity, and low profit margins for generic therapies "could lead to delays in treatment that could result in worse outcomes."Kestra Kelly is battling ovarian cancer for the second time after she lived cancer-free for more than a decade. Kestra, a mother who now requires chemotherapy, was told she was given one less dose than her regiment required as a "conservation method"."I met with my doctor & she basically said we’re lowering your dose as a conservation measure," Kestra said.

PHILADELPHIA - Firefighters in Philadelphia are battling a massive junkyard fire that has raised air quality concerns for nearby residents. Firefighters from the Philadelphia Fire Department were called to the junkyard near the intersection of Harbison and Torresdale avenues around 3:30 p.m. SkyFOX flew over the inferno and captured plumes of dense black smoke rising high about the city. Officials instructed residents that live near the fire to avoid the area and stay inside as much as possible. The city has dispatched inspectors to check the air quality for potentially hazardous materials. If going outside is unavoidable, the city advised resident that strenuous exercise and areas of high congestion should be limited. People with underlying medical conditions should monitor for symptoms, including trouble breathing, nausea, and dizziness. Air quality in and around Philadelphia was already poor due to the burning wildfires in Halifax, Nova Scotia that prompted a Code Orange locally.

ORANGE BEACH, Ala. - A drone on the lookout for sharks in the Gulf of Mexico captured the moment a small shark circled a man and child who were swimming at an Alabama beach.Drone video from 15-year-old Jackson Silvio shows the man and child going further out into the water at Orange Beach on May 29 as the shark follows and eventually swims out to sea. At one point, the shark was within a few feet of the swimmers.It’s not uncommon to spot sharks near the shoreline of the Gulf of Mexico, according to Gulf Shores and Orange Beach Tourism.

PHILADELPHIA - Smoke from a wildfire more than 600 miles away is impacting the Delaware Valley, bringing hazy conditions to the area and prompting air quality alerts. In Halifax, Nova Scotia, more than 16,000 people have been forced to evacuate as a wildfire burns. Authorities say the fire has burned more than 25,000 acres of land and damaged about 200 homes. Canadian Prime Minister Justin Trudeau addressed the wildfires in a tweet, calling the situation "incredibly serious." Despite being hundreds of miles away, smoke from the burning wildfires is impacting the Delaware Valley. A wildfire burning in Nova Scotia has led to code orange air quality alerts in several New Jersey and Pennsylvania counties.In Chester County, the West Chester Fire Department is warning about hazy smoke and a burning odor in the air. Officials say there is no immediate threat to the area, but code orange air quality alerts have been issued for several counties in Pennsylvania and New Jersey. Sensitive groups like children, the elderly and those with respiratory conditions should limit time outside due to the smoke particles in the air. The smoke from the fire will also cause hazy skies and a vibrant-colored sunrise and sunset, according to FOX 29's Sue Serio. FOX 29's Sue Serio has your Wednesday morning weather forecast.

BRISTOL, Pa. - A Bucks County woman is facing charges after authorities say she shot and killed her husband at a local park Tuesday morning. Sammar Khan, 40, is accused of shooting 38-year-old Faisal Iqbal during what witnesses described to police as an argument at Bristol Borough Wharf. It's alleged that Khan, a Levittown resident, and Iqbal were talking near the coastline when Khan started speaking loudly in another language. Witnesses reported hearing a ‘pop sound’ followed by Khan and Iqbal wrestling. More gunshots were heard by witnesses before Khan and Iqbal started walking towards the parking lot, police said.MORE LOCAL HEADLINESIqbal asked a witness to call 911, at which time police say Khan shot Iqbal twice which caused him to collapse in the grassy area between the water and parking lot. It's alleged that as Iqbal laid on the ground defenseless, Khan walked over and shot him twice in the torso and once in the head. Responding officers from the Bristol Borough Police Department found Khan with blood on her clothing.

(Credit: University of Dubuque) DES MOINES, Iowa - A 21-year-old college student and athlete drowned after he swam in an Iowa lake with friends, according to authorities. The Marion County Sheriff's office said they received a call Saturday evening from the Whitebreast boat ramp at Lake Red Rock in Des Moines. The caller said a group a young men were swimming outside the designated area when one of them went underwater and did not resurface. A search ensued and on Sunday, authorities used sonar equipment and retrieved the body of Urias Gbarjolo of Johnston, Iowa. RELATED: Iowa apartment building partially collapses, prompting massive rescue effortAn autopsy will be conducted. Gbarjolo attended University of Dubuque and was a member of the school's track and cross-country teams.

PHILADELPHIA - The Philadelphia Police Department is investigating a two-car crash that left one person dead in Philadelphia. According to authorities, the crash took place on the 6100 block of Harbinson Avenue in the Wissinoming section of the city on Tuesday at 9:16 a.m. Officials say a man driving a black Mercedes C300 was traveling west on Benner Street when he ran a red light and was hit by a white Ford E150 going south on Harbinson Avenue. MORE LOCAL HEADLINESThe driver of the Mercedes was pronounced dead on scene by medics just before 9:30 a.m., per police.Authorities say the scene was held and no person is in custody at this time.

The CEO of a mental health care firm has hit back at a critical watchdog report into its Stockport hospital - where three young women died within weeks last year. The Care Quality Commission (CQC) deemed child and adolescent mental health (CAMHS) services at Cheadle Royal Hospital, also known as the Priory Hospital Cheadle Royal, to be 'inadequate' following a recent inspection.
