BASL says 21A must not be used as an excuse

COLOMBO (News 1st) – The Bar Association of Sri Lanka says that the enactment of the 21st Amendment must not be used as an excuse or mechanism to discontinue Chairpersons and members of Commissions whose services helped establish public faith in such Institutions.

The Bar Association went on to note that the 21st Amendment to the Constitution regrettably does not completely restore the status quo ante which prevailed prior to the 20th Amendment to the Constitution and does not place adequate checks and balances on the powers of the Executive President.

It noted that the 20th Amendment to the Constitution rolled back the checks and balances which were introduced by the 19th Amendment on the exercise of executive power.The Bar Association of Sri Lanka calls upon the President, Prime Minister, Speaker, Leader of the Opposition, and all political parties represented in Parliament, to firstly ensure the integrity of nominations to the Constitutional Council and to ensure that such nominations are devoid of partisanship and in a manner that will inspire public confidence.The BASL noted that for this purpose, it is important to ensure that the non-ex-officio members of the Constitutional Council appointed from among Members of Parliament and from among non-Members of Parliament be done in a transparent and open manner and to also ensure that those appointed will be acceptable to the members of the public and be persons of the highest integrity and reputation..

COLOMBO (News 1st) – Sri Lanka's Minister of Labour and Foreign Employment  Manusha Nanayakkara in Parliament informed today (22) that the law will be strictly enforced against those involved in trafficking women to Oman, where they are auctioned and sold to the highest bidder.Minister Manusha Nanayakkara revealed to the parliament that as per the data available with the Sri Lanka Foreign Employment Bureau there are 12 Sri Lankan women at the Safe-House in Oman operated by the Sri Lankan Embassy who had registered themselves with the SLFEB, and another 65 who had used visit visa to travel to Oman citing other reasons to Sri Lankan authorities.He added that 70 Sri Lankan women registered with the Sri Lanka Foreign Employment Bureau, and 7 Sri Lankan women have used visit visa and are currently held in Dubai.The Minister went on to note that Sri Lankans who registered with the Sri Lanka Foreign Employment Bureau and face issues overseas can be brought back to the country without any issue, however, there is growing concern over the rise in numbers using visit visa for employment purposes.He added that legal action was instituted on over 100 incidents of abuse, and multiple suspects were arrested based on the investigations.He revealed to the house that only 40 Sri Lanka Foreign Employment Bureau personnel are assigned to meet the needs of all countries, however, Cabinet has approved to recruit of another 50 personnel.Minister Manusha Nanayakkara individual at the Sri Lankan Embassy in Oman who is accused of committing sexual abuse towards Sri Lankan women over there has been interdicted and will be brought back to the country where he will be arrested on arrival, and will be investigated.

COLOMBO (News 1st) – Journalist Tharidu Jayawardena had filed a private complaint against ASP Nalin Dilruk, and SSP Roshan Dias for alleged obstruction caused during a protest on the 10th of October 2022 in Colombo.The Attorney General on Tuesday (1) had filed an ex-parte motion to call for the matter, and on Wednesday (2) counsel appearing for the complainant expressed their objections over this move.Appearing for the complainant President's Counsel Saliya Peiris told the court that the Attorney General is not a person with special privileges.The President's Counsel pointed out that the Attorney General was not a party to the private plaint filed against two police officers, and noted that summoning the case via an ex-parte motion to obtain orders sets a negative precedent.He added that if the Attorney General wanted to call for the case via a motion, the Attorney General must inform the complainant or his counsel.President's Counsel Saliya Peiris stressed that Senior State Counsel Saminda Wickrama appearing for the Attorney General had concealed the fact that he did not inform the complainant or the counsel from the Magistrate, and presented facts over the matter.He informed the court that he was only made aware that the case was called up via a motion on Tuesday (1) following media reports on the matter, and that the counsel for the state had told the court that the complainant had made false submissions to the court.President's Counsel Saliya Peiris stressed that the complainant or the counsel have never produced any false fact to the country, and had never misled the court.He pointed out that the submissions made by the Attorney General's Department were published in the media, and though the Attorney General had

COLOMBO (News 1st)- Sri Lankan President Ranil Wickremesinghe has instructed the security forces to conduct an investigation in an impartial manner in to the recent incident inside the Yala National Park where a fleet of Off-Road vehicles were seen performing doughnut inside the park premises.Cabinent Spokesperson & Minister Bandula Gunawardena said that the President also instructed to penalize those accountable.Nine people and seven jeeps that were involved in the Yala Fiasco over the weekend, that received widespread condemnation, were produced to the Tissamaharama District Court on Wednesday (26) after they surrendered to the Yala National Park Rangers Office earlier in the day.The Magistrate ordered for the suspects to be released on a personal bail of Rs. 500,000/- each.In the meantime, a three-member Committee was appointed to conduct further investigations on the Wildlife officials who have been temporarily suspended for failing to prevent incident from taking place.This committee will be chaired by an Additional Secretary to the Ministry of Wildlife and Forest Resource Conservation.A total of seven Park Rangers have been interdicted until the investigations are over, and they are charged with dereliction of duty and for their direct or indirect involvement in the incident.The matter was also raised during Wednesday's (26) cabinet briefing, and Minister Bandula Gunawardena.

COLOMBO (News 1st)- Sri Lanka's Supreme Court has determined that the 'Bureau of Rehabilitation' bill as a whole is inconsistent with Article 12(1) of the Constitution and as such may be enacted only by the special majority required by Article 84(2) of the Constitution.However, However, this inconsistency shall cease if:(i) All references to “ex-combatants,” “violent extreme groups” and “any other group of persons” are deleted from the Bill;(ii) The Bill is limited to the rehabilitation of drug dependent persons and such other persons as may be identified by law. Parliament Speaker Mahinda Yapa Abeywardena announced the Supreme Court's determination on Thursday (20) to parliament.The complete determination is as follows: I wish to announce to Parliament that I have received the Determination of the Supreme Court in respect of the Bill titled “BUREAU OF REHABILITATION” which was challenged in the Supreme Court in terms of Article 121(1)of the Constitution.On an overall consideration of the provisions of the Bill, the Supreme Court has made the following Determination:—A. COLOMBO (News 1st) – Most Venerable (Dr) Pallegama Siriniwasa Thero, Custodian & Chief Priest of the Maha Bodhi & Atamasthanadhipathi of Anuradhapura passed away on Tuesday (18).President Ranil Wickremesinghe has appointed North Central Province Governor Maheepala Herath &  Buddhasasana, Religious & Cultural Affairs Minister Vidura Wickramanayaka to coordinate arrangements for the full state-sponsored funeral of Most Venerable (Dr) Pallegama Siriniwasa Thero, Custodian & Chief Priest of the Maha Bodhi & Atamasthanadhipathi of Anuradhapura.The Most Venerable Thero passed away at the age of 69 while receiving treatment at a private hospital in Colombo.The Venerable Thero also served as Chief Sangha Nayake for the North Central Province.Chief Incumbent of Ruwanweli Maha Seya Venerable Pallegama Hemarathana Thero announced that the remains of the late Most Venerable (Dr) Pallegama Siriniwasa Thero will be moved to Anuradhapura on Wednesday (19) evening.The remains will be placed at a private funeral parlor until 12 noon on Wednesday (19).The Most Venerable (Dr) Pallegama Siriniwasa Thero was born in Pallegama, Dambulla on the 2nd of January 1953 to Karunasena Mudiyanselage Tikiri Bandara Nilame, and Dukganna Walawwe Anula Kumarihamy.The late thero was ordained at the Ruwanweli Maha Seya in Anuradhapura in 1968.He was educated at the Vidyodaya Pirivena in Maligakanda, Sandalankawa Shasthrodaya Pirivena, Sri Jinarathana Pirivena in Gangarama, and later graduated from the University of Kelaniya.The Late Most Venerable (Dr) Pallegama Siriniwasa Thero was also bestowed with a doctorate by the Government of Thailand commending his services to the Dhamma.In 1975 the late thero obtained the Upasampada, the Buddhist rite of higher
